    CLAIM CALCULATOR

What is your unpaid invoice worth today?

Enter the amount and due date – the calculator shows default interest, the lump-sum fee, court fees for the payment order and the day on which the claim becomes time-barred.

Initial review free of charge, response within one working day.

      How the calculator works
      • For claims between businesses: default interest at 9 percentage points above the base rate (Section 288(2) BGB), calculated to the day on a 365-day basis, using the base rate applicable in each half-year. Currently: –, i.e. – p.a.
      • Default without a reminder 30 days after the due date and receipt of the invoice (Section 286(3) BGB); with an earlier reminder from its receipt.
      • Limitation: generally three years, starting at the end of the year in which the claim arose (Sections 195, 199 BGB). Suspension, restart and different limitation periods are not taken into account.
      • Court fees: half fee under Section 34 GKG based on the principal claim, at least €38. In addition, there are lawyers’ fees under the RVG, which the debtor also bears if successful.
      • Non-binding calculation, not legal advice. Whether and to what extent claims exist is something we review in each individual case.

      THE DIFFERENCE

Enforcing claims. Keeping customer relationships in view.

Unpaid claims are not just a legal matter. Often there is a long-standing and commercially important customer relationship behind them.

That is why KODEX Collect does not rely on maximum escalation, but on the right escalation.

We review every claim legally and commercially and tailor the approach, tone and next steps to the specific situation. This allows claims to be pursued consistently without placing unnecessary strain on valuable business relationships.

Lawyer-led debt collection from a single source: Unlike a collection agency, we also represent your claim in court proceedings – without changing service provider and without loss of information.

A clear process. From the unpaid invoice to enforcement.

      1.
      We review.
Claim, limitation, documents, possible objections, insolvency notices and commercial plausibility. After that it is clear whether and how we take action.
      2.
      We demand.
Out-of-court demand for payment and correspondence with your business partner – on request also a settlement or payment in instalments.
      3.
      We enforce.
If an out-of-court solution is not possible, depending on the claim and objections we pursue the court dunning procedure with a payment order and enforcement order, or file a lawsuit.
      4.
      We execute.
Once an enforceable title exists, we carry out enforcement with appropriate measures.
      5.
      We stay on it.
We monitor unrealised titles and reassess them at defined points in time.

      DIGITAL AND PERSONAL

      Technically efficient. Personally available.

Standardised processes make receivables management efficient. Personal contacts make it good. KODEX Collect combines both.

Digital intake processes and clearly defined processing steps reduce coordination effort and ensure that new claims are taken on quickly and in a structured way.

At the same time, receivables management remains legal advice. That is why with us you reach not just a portal or a ticket system, but people who know your case and make decisions together with you.

What technology handles – and what people decide

      Supported by technology

      Handled digitally

      • Capturing your claim and documents via the form

      • Clearly defined processing steps, so nothing gets stuck

      With sound judgement

Decided by people – with you

      • Initial review by the firm: claim, limitation, objections, economic plausibility
      • On request, you see the first letter to your customer in advance
      • Any escalation only in agreement with you – you decide on court steps

With long-standing customers, tone matters. You stay in control.

      FAQ

      Frequently asked questions

For unpaid claims of businesses against other businesses – from a single invoice to larger portfolios of claims.

For individual claims from €500, the principal claim remains entirely yours; if successful, the debtor reimburses our statutory fees. If out-of-court collection ends without success and the procedure is not continued, we charge a flat fee of €59 net.

If the debtor is ordered to pay, the debtor bears the court costs. In the court dunning procedure, statutory lawyers’ fees under the RVG also arise, which the debtor must likewise reimburse if successful. We tell you the exact amount before every court step.

No. We determine the approach based on the legal and commercial situation. The aim is the appropriate level of escalation – not the maximum.

Depending on the case, in particular the invoice, contract or order, proof of performance and the relevant correspondence.

After receiving your enquiry, we get back to you within one working day with an initial assessment.

Payments are made to our lawyer’s client trust account. We forward incoming amounts to you without delay.

Before every step we check the insolvency notices. If insolvency proceedings have been opened, we file your claim in the insolvency table and represent you towards the insolvency administrator.

Both may collect claims out of court and pursue the court dunning procedure. If the claim is disputed and a lawsuit is necessary, a collection agency additionally needs a lawyer – with us, everything stays in one hand. In addition, as a law firm we review objections, limitation and legal enforceability right from the start.
